GENERAL AND SPECIFIC TERMS AND CONDITIONS OF LOCK&BEACH CONTRACT

OBJECT

These general and specific terms and conditions govern the rental of lockers held by the entity Lock&Beach via the website www.lockbeach.es, as well as through the touchscreen located in the commercial premises at Lock&Beach in Valencia, avenida malvarrosa 21. They also govern the contractual relationship between Lock&Beach and the User subscribing to the Lock&Beach locker service.

The parties will be referred to interchangeably as Lock&Beach and User or Client.

THE SERVICE

Lock&Beach offers its Users the opportunity to rent one of its lockers for natural day periods (during the time slots offered by Lock&Beach).

What types of lockers does Lock&Beach offer?

Lock&Beach offers three types of lockers:

Medium lockers (M), measuring 580mmX436mmX293mm. These lockers can hold approximately 1 cabin suitcase and a small backpack. Large lockers (L), measuring 580mmX436mmX560mm. These lockers can hold approximately 2 cabin suitcases and a medium-sized backpack. Extra-large lockers (XL), measuring 580mmX436mmX856mm. These lockers can hold approximately 4 cabin suitcases, one very large suitcase, or a large suitcase and a cabin suitcase.

What can a User place in their locker?

Within the limits established in this document (see Locker Usage Limits section), a User can place the items they wish in the rented locker(s).

How can a User check if there are lockers available at Lock&Beach?

This can be verified by accessing the website www.lockbeach.es and initiating a reservation.

For how long can a User rent the same locker?

The User can rent a locker for a period ranging from a minimum of 1 day to a maximum of 10 natural days, and this period must fall within the opening months of the establishment.

When can a User access the rented locker(s)?

The rental service for each locker will be accessible during the hours indicated in the commercial premises, every day of the week, 365 days a year, from 00:00 to 24:00. Outside of these hours, it will not be possible to access the lockers, as the premises where they are located will be closed for security and maintenance reasons.

Once the items have been placed by the User, can they only access the locker to retrieve them?

No. Once the User has placed the items, they can access the locker as many times as they wish, but they must always leave it closed and empty at the end of the rental period.

What are the prices that the User must pay per type of locker/day?

Prices

The prices applicable to each product are those indicated on the website at the time of purchase. The final prices displayed on the website and on the touchscreen include VAT and refer to the rental of a locker (according to its size) for one natural day (from 6:30 AM to 6:29 AM).

Offers will be clearly indicated by correctly identifying the previous price and the offer price.

Lock&Beach reserves the right to make, on the website and in the commercial premises, any modifications it deems appropriate at any time and without prior notice, updating products and services daily based on market conditions.

Payment method

Purchases can be settled by any of the methods indicated on the website at the time of reservation or on the touchscreen located in the commercial premises. In particular, by credit or debit card.

How to reserve and use the lockers?

The lockers offered by Lock&Beach are entirely automated.

Locker reservations can be made via the website www.lockbeach.es.

The User must access the website www.lockbeach.es and go to the Reservations section. In this section, they must select the number of lockers, the size, and the reservation period. Similarly, they will need to enter their name, surname, mobile phone number, and email address.

Once these Conditions are accepted and payment is made by card, and the subscription is completed, the User will receive by email and/or SMS on their mobile phone the confirmation of the reservation made, the number of the reserved locker(s), and its security code to access the premises and the locker(s).

On the day of the reservation, at the entrance of the commercial premises, the User must enter the code sent to them by email and/or SMS on the touchscreen keypad next to the main entrance door. Once the code is entered correctly, the door will open automatically, and the User can access the commercial premises.

Similarly, once the User has rented one or more lockers, they must go to the touchscreen in the commercial premises, enter the number of the reserved locker(s), and enter the security code sent to them by email and/or SMS to access the locker and place the items.

How can a User modify or cancel their locker reservation?

Once the reservation is made, if the User wishes to modify or cancel it, they can do so via the website www.lockbeach.es.

To modify or cancel the reservation, the User must access the Reservations section, select the reservation they wish to modify or cancel, and follow the steps indicated by the website.

Modification or cancellation of locker reservations will only be possible if done 48 hours before the start of the reservation period. Beyond this deadline, no modification or cancellation will be accepted, and the User will not be entitled to a refund.

USER’S OBLIGATIONS

What should a User do when using Lock&Beach lockers?

The User undertakes to use the lockers correctly, not to deposit prohibited items listed in the Locker Usage Limits section, and to remove their items at the end of the reservation period.

What are the limits on locker usage?

It is prohibited to store in the lockers items that could affect the safety of people or the preservation of property, as well as those whose possession, distribution, transportation, or storage is prohibited by law. In particular, it is prohibited to store in the lockers:

Explosive, flammable, toxic, corrosive, or health-hazardous items. Firearms or bladed weapons of any kind. Illicit substances. Objects or substances whose possession, transportation, or storage is prohibited or regulated by current laws. Living or dead animals. Perishable foods or products. Sums of money, securities, or valuables. Jewelry, precious metals, gemstones, or other valuable items. In case of non-compliance with these restrictions, Lock&Beach reserves the right to remove items deposited in the lockers, impose penalties on the User, and/or terminate the contract, without prejudice to Lock&Beach’s right to charge the User for additional costs incurred.

LIMITATION OF LIABILITY

Lock&Beach undertakes to implement the necessary measures to keep the lockers in good working order and available to Users.

Lock&Beach is not responsible for losses or damages to the property of Users resulting from force majeure or circumstances beyond its control. Lock&Beach is also not responsible for the incorrect use of lockers by the User.

Lock&Beach will not be liable for losses or damages resulting from the User’s violation of restrictions on items that can be stored in the lockers, in accordance with the Locker Usage Limits section.

In case of loss, damage, or any other issue related to items deposited in the lockers, the User must immediately inform Lock&Beach by email or phone.

CONTRACT TERMINATION

How does the contractual relationship between Lock&Beach and the User end?

The contractual relationship between Lock&Beach and the User will end when the User completes the rental period of the reserved locker(s). The User will be responsible for removing their items and leaving the locker(s) empty and closed.

Lock&Beach reserves the right to terminate the contract with the User in case of non-compliance with these general and specific terms and conditions, without prejudice to Lock&Beach’s right to charge the User for additional costs incurred.

APPLICABLE LAW AND JURISDICTION

These general and specific contract terms and conditions will be governed by the laws in force in Spain.

For any dispute arising from the interpretation or execution of these terms, the parties submit to the jurisdiction of the competent courts in the city of [*], expressly waiving any other jurisdiction that may correspond to them.
